Jason Jennings - Llanddewi Brefi Ceredigion & Jarratt Jon Ivey - Aylesbury Buckinghamshire attended court on my behalf from 09:15 until 15:30. Two true friends. Both of whom are moral, good, decent and honest men.

Neither defence witness was called to give evidence under oath because of the shortcomings and, I would argue, the negligence of the CPS who are the party responsible for bringing me, a totally innocent man, to criminal prosecution at trial.

The CPS's prosecution of me was mucked and rescheduled for 25/6/13 @ Milton Keynes Magistrates Court.

Because of, what can fairly be described as the unprofessional incompetence and lack of due diligence on the part of the CPS and HMCTS listings dept. and through absolutely no fault of ours - the defence team - I am required to impose upon and to inconvenience Jason and Jon for a second time to appear as defence witnesses before Milton Keynes Magistrates Court when the CPS's unconscionable, ill conceived and wholly ill judge prosecution of me recommences in two months time.

Jon, Jason, thank you for standing up next to me and alongside me in my fight to defend myself and uphold my right of: Honest comment, fair comment, free speech and freedom of expression in relation to ALL of the TRUE FACTUAL and ACCURATE content posted within my public social media websites in relation to: BT Group & the Communication Workers Union and the numerous sad, dishonest, deceitful, mendacious, wicked and Godless workplace / trade union place bullies and harassing cowards - identifying applicable BT employees (management operatives & field team operatives) and/or TU officials/members - therein.

[aka …a tirade (sic) CPS 26/4/13] - How so very very devastatingly and woundingly hurtful :-( not to mention gratuitously rude and comically risible :-) of the CPS to label my perfectly reasonable, considered and appropriate social media comm which I posted just prior to be prosecuted by the CPS "a tirade" simple because the CPS's star witness had squeaked out ..he's put me name ***** ***** in nit, look vhere mate see it?... (sic). A "name" which was, as of the time of the CPS's star witness's squeaky complaint, a matter of public record !

I believe my social media sites content to be lawful, legal, legitimate accurate and factual information postings. I refute the assertion of any criminal harassment of any other person or entity.

The entirity of my social media content is: Honest comment, fair comment, fair opinion and the exercise of my freedom of expression as described within Article 10 of the ECHR.

It should be noted that my fair opinion and comment, my honest comment, honestly held and honestly expressed in respect of my social media websites are posted without malice toward any individual or entity. 

Rather all my social media content are based upon and supported by true facts, accurate and precise fact which I post with full justification and with full and sufficient clarity in respect of black BT employees and/or CWU members and white BT employees and/or CWU members, all of whom have been instrumental in and fundamentally involved in consistently and constantly pursuing a discriminatory, harassing, victimising, harmful, distressful, alarming and damaging course of conduct toward me within BTs workplace over the period of time stated within all of my social media websites.

I have indicated and identified the subject matter with sufficient clarity throughout the entirety of my social media content and postings. That fact is, I would argue, indisputable and made demonstrably clear within all of my public websites.

I choosing to use the right of every citizen to be offensive towards, to be insulting towards and to heap abusive opprobrium upon numerous black persons and white persons within BT and the CWU is not and cannot be believed to amount to a course of conduct amounting to criminal harassment. 

I believe that expressing offensive, abusive, insulting honest comment, honestly held by me, about the unlawful BT & CWU workplace conduct of persons known to me does not constitute criminal conduct of harassment contrary to the PHA. 

Rather, that in respect of all of my social media content …I believe that in the particular circumstances my pursuit of the course of conduct to be reasonable.  

The fact that another black person(s) or another white person(s) considers my honestly held honest comment to be objectionable and offensive does not / cannot amount to a course of conduct of criminal harassment. 

I am presumed to have the legal right and freedom of any British citizen to express, without malice, honest comment, honestly held about black people and about white people within BT and within the CWU. 

I have exercised that legal right and will continue to so do - within my social media websites. 

As a defendant in criminal prosecution I assert, for the CPS to prosecute me for pursuing a reasonable course of conduct is unconscionable. The CPS’s case against me asserting criminal harassment has no merit, lacks any merit and should, the defendant would argue, be treated as such by a court.

I consider the CPS are attempting to interfere with my right of freedom of expression and restrict my right of freedom of expression and my right to free speech, wholly unjustifiably. My honest comment does not target a particular racial or ethnic group, therefore no interference by the CPS or the court is justified in interfering with and restricting my right to freedom of expression. 

The exact same right possessed by the numerous black persons and white persons I have lawfully, legally, legitimately and justifiably identified and cited by their known bad reputation, by their known bad character and by the unacceptable and reprehensible BT & CWU workplace conduct, maliciously perpetrated against me by those numbers of black persons and white persons who are BT employees and CWU members, within my social media websites.

A TV trailer for the comedy Airplane has just jogged my memory. Therefore - A little example of just how utterly stupid, fucking simple and brain dead Uncle Toms are.

c.2011. In an upstairs office in BTs HP19 8BP (nick)Griffin Ln. yard, I was attempting - (like banging my head against a brick wall and/or like attempting to talk sense to a twat brain) - to talk about attitudes toward racism, and the cowardly deceit that is the fall back position of cowardly workplace racists etc. - to a BT Uncle Tom, and I said how hilarious, entertaining and appropriate I and most other people found the put down spoken by the girl in the comedy film Airplane when she was offered milk for the coffee she had just accepted from the young white male who was attempting to impress her and she refused the milk and replied ...I take it black, like my men.

BTs Uncle Tom replied ...yeah but they wouldn't get away with that today in a film.

I could have puked up at the demonstrable stupidity and simple mindedness of the BT Uncle Tom to whom I was talking. I immediately decided it would be a complete and total waste of my time and energy to attempt to explain the - joke - to the BT Uncle Tom and instead I just looked at him and said to myself ...Colin, this is the thick Uncle Tom cunt that you are relying on to have the moral courage and the diginty to present honestly and truthfully to BTs FS1GC against BT employees who call him John (Coffey) to his face - and he bends over and takes it up his Uncle Tom sphincter from cowardly racist twats suck as lee foulkes, steve halsey et al. Colin when the time comes this stupid as they come / stupid as fuck Uncle Tom cunt is going to stab you in the back and protect his cowardly, thick as shit Uncle Tom self  in private behind your back within BT's in confidence / confidential internal formal grievance complaints and appeals procedures bullshit.

Dec. 2011 - BT Legal are ordered to disclose to me some 300+ pages of BT documents - and my prediction was proved 100% correct, when the verbal conduct of the BT Uncle Tom was presented to me in black and white exactly and verbatim  what was said / presented to white BT investigating managers by Uncle Tom Prick.

AN ACCURATE AND GOOD PICTORIAL REPRESENTATION OF: SIR DOMINIC WINSTON CHURCHILL MARTELLO STUPIDSTAFANO'S - WK/END AWAY AT THE COAST - PARTNER / CHAUFFEUR / BODY-GUARD  & BEDFELLOW.

This tale of a weekend away-break - on a car buying 'adventure' (sic)  was told to me by a BME BT employee / CWU member whom I periodically worked alongside c. 2008/11 (I doing the work, as the BME BT employee in question - just like his fuck buddy/school buddy martello - is incapable of doing anything like a honest day's work.)

The BME BT employee in question was always extremely upset and angry whenever he repeatedly fixated on the B&B and petrol money owed to him by dominic martello/distefano - "..that useless cunt still owes me for the B&B and petrol. I paid the fucking lot and the cunt said he'd pay me back, I'm still fucking waiting". (sic)
 

Whenever the BME BT employee, in his paranoid fixation on his habitual retelling of his sad tale of woe to me when we were either at HP19 8BP Griffin Ln. or when on-site. I in turn would say - ***** why don't you tell him you want him to repay the money he owes you for when you abandoned your partner and two children to go on your stupid, ill fated and poorly thought through - wk/end away car-buying love-in at the coast, when you had a partner and two children to spend the wk/end with?

The BME BT employee - who would repeatedly retell to me the pathetic and sad tale of the disaster of his little wk/end away break 'adventure' he went on with his Stoke Mandeville school buddy/fuck buddy dominic martello/distefano. That same BME BT employee - somewhat bizarrely - informing (sic) me that - "...I said it was to do with work"  (sic) - when I had enquired of the BME BT employee who was volunteering this unsolicited information to me, as to what was the response/reaction of his partner? who was left to look after their two children, one a  new-born "...whilst you drove martello / distefano - down to the coast for a car-buying love-in? Coughing up / paying for - the whole wk/end away-break, on such a stupid and ill conceived second hand car-buying 'adventure' that dumbstefano / martello had talked you into accompanying him on". (sic)  

I further stated to the BME BT employee who voluntarily, habitually and regular-as- clockwork bleated - like a fixated sheep - about: "...my B&B and petrol money that that cunt martello owes me" (sic) *CONTD...
 

[ Honest comment: I personally believe the BME BT employee in question is paranoid (sic) about dominic martello-distiffano / paranoid about neil landymore / paranoid about danny thorp / paranoid about matt gordon / paranoid about BT MTW "cousin andy" et al / paranoid about having his fondness for / his addiction to and his obsessive disgusting fetish for tonguing white BT sphincsters, known about by other black people including his estranged nearest & dearest et al. - and the same BME BT employee  i.e. john coffey - is paranoid & shy about so many things. And I believe this is made worse by  the BME BT employee's habitual abuse of and addiction to the following sad habits: Pizzas, McDonalds, Ice Road Truckers, Sowing (i.e. playing with sowing machines/cloths alterations) Vacuuming stinking un-salvageable carpets at HP20 1**, Cakes and Ice Cream, and his pathetic addiction to his BT Openreach overtime desperate dependency.]

This tale of the £3000 bacon sandwich was told to me by an Uncle Tom Prick black person BT employee / CWU member whom I, periodically, worked alongside c. 2008/11 (I doing the work, as the Uncle Tom in question is incapable of doing anything like a honest day's work.) I received a telephone call from dominic martello informing me - that morning he was located by a Pole Erection Unit BT vehicle talkng to two BT employees - one acting C1 grade BT employee named andrew ruzicKA and a "substantive C1 grade BT IT Gold User team leader supervisor" BT employee - when those two BT employees received a phone call from BT line manager steve wingrove instructing them both to attend a meeting at Aylesbury ATE immediately. martello stating that ...the fat man said let's finish loading these poles then we'll go up there to see what he wants..(sic)

d martello and I agreed that the invite by s wingrove was about investigating the contents of the whisle blowing e/b - a part of which dominic martello himself had assisted me to compile on his return from his holiday in Australia, I subsequently handing the e/b to level 3 BT line manager T Ferguson in June 2006 who in turn handed the e/b to Accenture HR Specialist S Lawson to pass onto the appropriate BT line management for investigation - and I reminded d martello that my PEU work mate Jason Jennings would also be called to meet with s wingrove and kevein coll (who was the other manager BT ordered to investigate the whistle blowing e/b's contents) as I had named Jason as a witness to some of the workplace thefts of BT property and assets, the dangerous / life endangering working practises and the abusive misuse of BT assets, BTpremises and BT facilities etc. etc. which I had detailed in the e/b against the two BT employee concerned. I asked dominic martello to see what more he could find out. 
d martello then proceeded to inform me of what else was been talked about and by whom and what was taking place at HP19 8BP Griffin Ln. as a result of the ongoing FS1GCs and GAs I had raised against BT shop floor employees and BT line managers. i.e. garry lawrence - level 2 manager, dean newport-hall - silly little boy new starter, andrew ruzicKA - bullying big mouth gobshite, bob reader & martin norhtfield - Colindale TEC and ron ryall ReadingTEC.

Some short time later d martello called me to relay that: I saw the fat man and ****** in the yard and casually asked them what wingrove wanted to see them about...(sic). martello told me that: ...****** boy just shook his head and pointed to the fat man and said - ask him - and walked off (sic). And that the fat one was reluctant to go into any detail. d. martello went onto say that ...judy (howard chalmers) is saying that ...he's involved steve now...(sic) i.e. s. newport-hall BT MTW manager -...but ***** and steve (newport-hall) are saying that he can't prove anything...(sic).

I told dominic martello to keep his ears and eyes open and report back. martello in turn said that he feared ...******, ruzicKA, chalmers, gordon, oliver and that lot are suspicious of me asking about things...(sic)

Listen very carefully Uncle Tom. It is not difficult for them to work out. They've already worked it out Uncle Tom. That's why your white BT massas are so very over friendly and engaging toward you when they are face to face with you, whilst pretending as though they like you and are your friends. Whilst pretending that they are being sincere and honest with you. They are compelled to act 'normal' toward you whilst not overdoing the eye contact with the black person Uncle Tom Prick they know you to be, that you have proved yourself to be!

Context: 

In an upstairs office in BTs Aylesbury TEC, I and a BME BT employee who's name is ***** ****** aka UTP, were discussing specific white BT employees against whom I was in the process of raising a Formal Stage 1 Grievance Complaint - i.e. BT employees andrew macdonald, lee foulkes and phillip douglas - as a result of those persons sick, sad, pig ignorant, gang mentality, cowardly and reprehensible workplace racist bullying and harassment of a black BT employee - me. c.Nov. 2010 & Jan.2011 *contd...

FYI No.1 - the BME BT employee I was having that conversation / discussion with was about to go on a six week holiday break to Trinidad and that same person had recently pleaded with me, begged me in fact, to collect him from Gatwick airport on the 28/3/11 and drive him back to Cambridge St. Aylesbury and I had agreed to do so.  [ I, in fact, dearly wished to tell the BME BT employee in question, go and fuck himself and to take public transport and not to be a parasitic scrounging sucker of other people's good will. - he having already sucked off his 'best mate' (sic) from Faircroft Way Aylesbury into driving him to Gatwick on 20 Feb.2011 - but I was prevented from telling the parasitic sucker BME BT employee to - ..fuck off and make your own sad way back from Gatwick airport with money that you haven't got - by virtue of my being dependant on that BME BT employee to present truthful and honest verbal evidence to BT FS1GC investigating managers when called upon to do so. I knowing very well, very well indeed, the real make up of / the actual make up of the kind of BT employee Uncle Tom Prick 'black person' I was dealing with, and on whom I had to rely upon in respect of BTs FS1GC internal procedures. 

So I was, unfortunately, not in a position to refuse the BME BT employee's pathetic, scrounging begging for car transport from Gatwick.

FYI No.2 - In the course of one of a number of conversations I engaged in with a Bedfordshire - Waller Ave. - BME BT employee named Geoff Williams-Thomas c. Nov. 2008/9 about the historic and contemporaneous / ongoing BT workplace racist bullying and harassment and the subsequent victimisation and vendetta practised against me by known white and black BT employees as a result of my standing up to, confronting and challenging that BT workplace racist bullying, racist harassing and victimisation behaviours and conduct of white and black BT employees. Geoff Williams-Thomas presented to me:

...***** said he's sorry and regrets he never spoke up and told the truth about what was happening and what he and other people like dominic knew....(sic)

(n.b. that is a verbatim quote & if it is doubted, simply go and ask Geoff Williams-Thomas directly to confirm or deny the factual accuracy of that quote - (geddit john [coffey] bwoy! )

In the course of the conversation I was engaged in with the BME BT employee in question, I was speaking about phillip douglas - who along with his puppet master lee foukles - is a Woodstock Rd. Oxford BT operative. On the point of my speaking the word ...Phil... the BME BT employee to whom I was talking interjected and said ...Who Phil the nigger? and he then chuckled and smiled broadly at me.  I returned a broad smile and said ...Yeah, that'll do for him. (sic)

On hearing the phrase - Phil the nigger (sic) spoken I was, at one and the same time genuinely impressed, genuinely surprised and genuinely amused and entertained at the phrase just used by the Uncle Tom black person BT employee ***** ******. I was, also, extremely disappointed in myself for not coming up with that so so appropriately and apposite turn of phrase myself.
 
IMPORTANT - I, Colin Jarvis, would have absolutely no difficulty whatsoever in taking full credit for the phrase "PHIL THE NIGGER" (sic) had I in fact thought of and spoken the phrase to the Uncle Tom black person BT employee named ***** ****** who was the 'person' who actually came up with, invented and presented the phrase ...Who Phil the nigger (sic) to me. 
(now in dat rite john (coffey) bwoy!)

Impressed: by the very appropriate attribution - to the dishonest bullying white BT workplace coward who is phillip douglas - of the sick, cowardly, deliberately offensive, purposely insulting and belittling racist filth which phillipa douglas himself was so happy and pleases to have been able to inflict on a black BT employee within BTs workplace, when he and his puppet master - the sad racist backward coward lee foulkes - considered it safe to do so. 

Surprised: by the originality of thought that produced the phrase - Phil the nigger. (sic). Especially as it emanated from the very dull brained, deluded, cowardly, dishonest, pathetic and sad individual who had actually brought the phrase - Phil the nigger - into being.

Amused and entertained: because I, straightaway, visualised the reaction and/or the response which this so so appropriate "tag" - with which the white BT employee phillip douglas had that minute been christened with by an Uncle Tom black person BT employee named ***** ******. 

The amusing and entertaining response/reaction of outrage which that "tag" would elicit from the cowardly, dishonest, lying twats phillipa douglas, his sweethearts leeanne foulkes and paula allington and steff halsey et al - were they to have been present and heard it, can only be imagined.

IT FOLLOWS FROM THE ABOVE TEXT THAT COLIN DERYCK JARVIS'S "paranoid" RESPONSE TO THE CONTENTS OF CPS EVIDENTIAL BUNDLE OF 5/4/13 IS AS FOLLOWS:
