Because, justly and properly, the State's prosecuting authority - i.e. the CPS - responsible for attempting to convict me on the entered criminal charges and hand me a criminal conviction and criminal record, is required and compelled by law, to prove me guilty - beyond a reasonable doubt - of the absurd charges brought against me by the CPS and required to prove me guilty - beyond a reasonable doubt - of the wilfully false and untrue allegations of criminal conduct that have been made against me by a BT employee  CWU member "black person" and by a BT employee ex-CWU member "white person" in tandem. Both of whom are the CPS's  witnesses within, what I would argue is, the State's unconscionable, unwarranted, unjustifiable, ill judged and outrageous criminal prosecution of an innocent black man. An innocent black man who is simply exercising a citizen's right and entitlement in law to make and to pass honest comment, that is legitimately and honestly expressed and articulated in an uncompromising and unambiguous manner in respect of the facts of the subject matter and related matters. Jason Jennings - Llanddewi Brefi Ceredigion & Jarratt Jon Ivey - Aylesbury Buckinghamshire attended court on my behalf from 09:15 until 15:30. Two true friends. Both of whom are moral, good, decent and honest men.

Neither defence witness was called to give evidence under oath because of the shortcomings and, I would argue, the negligence of the CPS who are the party responsible for bringing me, a totally innocent man, to criminal prosecution at trial.

The CPS's prosecution of me was mucked and rescheduled for 25/6/13 @ Milton Keynes Magistrates Court.

Because of, what can fairly be described as the unprofessional incompetence and lack of due diligence on the part of the CPS and HMCTS listings dept. and through absolutely no fault of ours - the defence team - I am required to impose upon and to inconvenience Jason and Jon for a second time to appear as defence witnesses before Milton Keynes Magistrates Court when the CPS's unconscionable, ill conceived and wholly ill judge prosecution of me recommences in two months time.

Jon, Jason, thank you for standing up next to me and alongside me in my fight to defend myself and uphold my right of: Honest comment, fair comment, free speech and freedom of expression in relation to ALL of the TRUE FACTUAL and ACCURATE content posted within my public social media websites in relation to: BT Group & the Communication Workers Union and the numerous sad, dishonest, deceitful, mendacious, wicked and Godless workplace / trade union place bullies and harassing cowards - identifying applicable BT employees (management operatives & field team operatives) and/or TU officials/members - therein.

(sic). A "name" which was, as of the time of the CPS's star witness's squeaky complaint, a matter of public record !

I believe my social media sites content to be lawful, legal, legitimate accurate and factual information postings. I refute the assertion of any criminal harassment of any other person or entity.

The entirity of my social media content is: Honest comment, fair comment, fair opinion and the exercise of my freedom of expression as described within Article 10 of the ECHR.

It should be noted that my fair opinion and comment, my honest comment, honestly held and honestly expressed in respect of my social media websites are posted without malice toward any individual or entity. 

Rather all my social media content are based upon and supported by true facts, accurate and precise fact which I post with full justification and with full and sufficient clarity in respect of black BT employees and/or CWU members and white BT employees and/or CWU members, all of whom have been instrumental in and fundamentally involved in consistently and constantly pursuing a discriminatory, harassing, victimising, harmful, distressful, alarming and damaging course of conduct toward me within BTs workplace over the period of time stated within all of my social media websites.

I have indicated and identified the subject matter with sufficient clarity throughout the entirety of my social media content and postings. That fact is, I would argue, indisputable and made demonstrably clear within all of my public websites.

I choosing to use the right of every citizen to be offensive towards, to be insulting towards and to heap abusive opprobrium upon numerous black persons and white persons within BT and the CWU is not and cannot be believed to amount to a course of conduct amounting to criminal harassment. 

I believe that expressing offensive, abusive, insulting honest comment, honestly held by me, about the unlawful BT & CWU workplace conduct of persons known to me does not constitute criminal conduct of harassment contrary to the PHA. 

Rather, that in respect of all of my social media content …I believe that in the particular circumstances my pursuit of the course of conduct to be reasonable.  

The fact that another black person(s) or another white person(s) considers my honestly held honest comment to be objectionable and offensive does not / cannot amount to a course of conduct of criminal harassment. 

I am presumed to have the legal right and freedom of any British citizen to express, without malice, honest comment, honestly held about black people and about white people within BT and within the CWU. 

I have exercised that legal right and will continue to so do - within my social media websites. 

As a defendant in criminal prosecution I assert, for the CPS to prosecute me for pursuing a reasonable course of conduct is unconscionable. The CPS’s case against me asserting criminal harassment has no merit, lacks any merit and should, the defendant would argue, be treated as such by a court.

I consider the CPS are attempting to interfere with my right of freedom of expression and restrict my right of freedom of expression and my right to free speech, wholly unjustifiably. My honest comment does not target a particular racial or ethnic group, therefore no interference by the CPS or the court is justified in interfering with and restricting my right to freedom of expression. 

The exact same right possessed by the numerous black persons and white persons I have lawfully, legally, legitimately and justifiably identified and cited by their known bad reputation, by their known bad character and by the unacceptable and reprehensible BT & CWU workplace conduct, maliciously perpetrated against me by those numbers of black persons and white persons who are BT employees and CWU members, within my social media websites.

A TV trailer for the comedy Airplane has just jogged my memory. Therefore - A little example of just how utterly stupid, fucking simple and brain dead Uncle Toms are.

c.2011. In an upstairs office in BTs HP19 8BP (nick)Griffin Ln. yard, I was attempting - (like banging my head against a brick wall and/or like attempting to talk sense to a twat brain) - to talk about attitudes toward racism, and the cowardly deceit that is the fall back position of cowardly workplace racists etc. - to a BT Uncle Tom, and I said how hilarious, entertaining and appropriate I and most other people found the put down spoken by the girl in the comedy film Airplane when she was offered milk for the coffee she had just accepted from the young white male who was attempting to impress her and she refused the milk and replied ...I take it black, like my men.

BTs Uncle Tom replied ...yeah but they wouldn't get away with that today in a film.

I could have puked up at the demonstrable stupidity and simple mindedness of the BT Uncle Tom to whom I was talking. I immediately decided it would be a complete and total waste of my time and energy to attempt to explain the - joke - to the BT Uncle Tom and instead I just looked at him and said to myself ...Colin, this is the thick Uncle Tom cunt that you are relying on to have the moral courage and the diginty to present honestly and truthfully to BTs FS1GC against BT employees who call him John (Coffey) to his face - and he bends over and takes it up his Uncle Tom sphincter from cowardly racist twats suck as lee foulkes, steve halsey et al. AN ACCURATE AND GOOD PICTORIAL REPRESENTATION OF: SIR DOMINIC WINSTON CHURCHILL MARTELLO STUPIDSTAFANO'S - WK/END AWAY AT THE COAST - PARTNER / CHAUFFEUR / BODY-GUARD  & BEDFELLOW.

This tale of a weekend away-break - on a car buying 'adventure' (sic)  was told to me by a BME BT employee / CWU member whom I periodically worked alongside c. 2008/11 (I doing the work, as the BME BT employee in question - just like his fuck buddy/school buddy martello - is incapable of doing anything like a honest day's work.)

The BME BT employee in question was always extremely upset and angry whenever he repeatedly fixated on the B&B and petrol money owed to him by dominic martello/distefano - "..that useless cunt still owes me for the B&B and petrol. I paid the fucking lot and the cunt said he'd pay me back, I'm still fucking waiting". (sic)
 

Whenever the BME BT employee, in his paranoid fixation on his habitual retelling of his sad tale of woe to me when we were either at HP19 8BP Griffin Ln. or when on-site. I in turn would say - ***** why don't you tell him you want him to repay the money he owes you for when you abandoned your partner and two children to go on your stupid, ill fated and poorly thought through - wk/end away car-buying love-in at the coast, when you had a partner and two children to spend the wk/end with?

The BME BT employee - who would repeatedly retell to me the pathetic and sad tale of the disaster of his little wk/end away break 'adventure' he went on with his Stoke Mandeville school buddy/fuck buddy dominic martello/distefano. That same BME BT employee - somewhat bizarrely - informing (sic) me that - "...I said it was to do with work"  (sic) - when I had enquired of the BME BT employee who was volunteering this unsolicited information to me, as to what was the response/reaction of his partner? who was left to look after their two children, one a  new-born "...whilst you drove martello / distefano - down to the coast for a car-buying love-in? Coughing up / paying for - the whole wk/end away-break, on such a stupid and ill conceived second hand car-buying 'adventure' that dumbstefano / martello had talked you into accompanying him on". (sic)  

I further stated to the BME BT employee who voluntarily, habitually and regular-as- clockwork bleated - like a fixated sheep - about: "...my B&B and petrol money that that cunt martello owes me" (sic) *CONTD...
 

[ Honest comment: I personally believe the BME BT employee in question is paranoid (sic) about dominic martello-distiffano / paranoid about neil landymore / paranoid about danny thorp / paranoid about matt gordon / paranoid about BT MTW "cousin andy" et al / paranoid about having his fondness for / his addiction to and his obsessive disgusting fetish for tonguing white BT sphincsters, known about by other black people including his estranged nearest & dearest et al. - and the same BME BT employee  i.e. john coffey - is paranoid & shy about so many things. (sic). 

And I believe this is made worse by  the BME BT employee's habitual abuse of and addiction to the following sad habits: Pizzas, McDonalds, Ice Road Truckers, Sowing (i.e. playing with sowing machines/cloths alterations) Vacuuming stinking un-salvageable carpets at HP20 1**, Cakes and Ice Cream, and his pathetic addiction to his BT Openreach overtime desperate dependency.]
